High Temperature Protection Legislation Seriously Lagged Behind "Four Days" And Then Asked For Labor Protection.

Under the background of frequent global extreme weather and intensified urban heat island effect, China's legislation on high temperature protection has lagged behind.


The Provisional Regulations for preventing heatstroke and cooling measures promulgated in 1960 have been "temporary" for 51 years.

The provisions of the labor law on high temperature labor protection are relatively vague, and the operability is not strong.

In July 2007, the four departments of the Ministry of health and the former Ministry of labor and Social Security jointly issued a notice to regulate high temperature allowances, high temperature work and rest systems.

Over the next few years, high temperature labor protection has been carried out in the form of joint notification issued by multiple departments every year.


Recently, the general office of the State Administration of work safety, the general office of the Ministry of health, the general office of the Ministry of human resources and social security, and the general office of the National Federation of trade unions issued a notice again, requiring the employers to arrange workers to work in the open air at high temperatures (up to 35 degrees Celsius daily).


However, "notice" is not law and regulation after all.

Under the circumstances of diversified employment modes in China, how strong is the implementation of a "notice" with red heads at the grass-roots level?

How wide is the coverage?

In reality, how about the provision of high temperature subsidies and the provision and distribution of heatstroke prevention facilities and supplies?

Is the labor protection status of migrant workers and dispatched workers at high temperature outdoor jobs the same as those of regular workers?

How can the "documents" lacking the corresponding accountability and punishment mechanism not be discounted in the specific implementation?


Four years ago, in 2007, the leading comrades of the CPC Central Committee and the State Council respectively asked for instructions.

The Legislative Affairs Office of the State Council will then hold seminars with departments such as the general assembly, the former Ministry of labor and social security, the Ministry of health and the General Administration of safety and supervision, and discuss the feasibility of the state's introduction of a unified high temperature labor protection law.

But insiders say that the legislation on high temperature labor protection involves industrial injury insurance, labor safety, medical and health, weather forecasting and many other links.


However, the greater difficulty factor and the harder inter ministerial coordination are

I hope not to repeat every summer's old saying, and expect high temperature outdoor workers to enjoy perfect protection according to law at an early date.
