REACH Authorization

In September 22, 2010, according to CHEMICAL WATCH, the EU REACH committee reached two authorized key agreements.


 


The meeting approved the first proposed substance of the first authorized list of the annex XIV issued by ECHA, but this list does not include short chain chlorinated paraffin (SCCPs, short-chain chlorinated paraffins).

SCCPs was not selected because the REACH Committee believed that the substance had been incorporated into the United Nations Economic Commission for Europe (UNECE) to prevent persistent organic diseases.

The following six substances must be authorized according to REACH annex XIV:


Musk xylene


4,4 '- two amino

Two phenyl methane

(MDA)


Six bromo cyclic twelve alkane (HBCDD) (and all major non enantiomers)


O-phenyl two formic acid two (2- ethyl hexyl) ester (DEHP)


Butyl benzyl ortho two benzoate (BBP)


Dibutyl phthalate (DBP)


If an enterprise wants to apply for authorization, it must strictly observe the start time and end time of Material Authorization (also known as sunset time).

The REACH Committee has approved the schedule of all authorized substances submitted by ECHA, but as most member states consider that HBCDD authorization may have a greater impact on the downstream construction industry users of the production and use of polystyrene insulation panels, and the energy saving and carbon reduction plans will also be adversely affected, HBCDD's application time is allowed to be extended for 9 months longer than the proposal.


In addition, annex XIII of the REACH code is set up for the classification criteria of persistence, bioaccumulation and toxicity (PBTs) and highly persistent and highly bioaccumulated (vPvBs) substances.

The annex I of the code amends the provisions of the relevant material assessment and chemical safety report.

The annex XVII of the regulations provides for a series of restrictive clauses relating to the manufacture, use and marketing of substances, products and articles.

CLP

The code and the new REACH code annex XIII have made minor modifications.

The two provision of annex XVII of the REACH code - forty-fourth of two phenyl ethers (diphenylether), five bromine derivatives (pentabromo derivatives) and fifty-third perfluorooctane sulfonate (PFOS) - were deleted.

The substances involved in the deletion clause have been incorporated into the EU POP convention.


The EU REACH Committee passed the PBT and vPvB material standards specified in Annex XIII of the REACH code and permitted the use of the "evidence weight" to assess the priority level of the authorized substances.

The debate within the REACH committee is mainly about the time limit for authorizing applications.


In the commentary, senior chemicals policy officer of WWF recommends that enterprises seek safer alternatives for authorized substances as soon as possible.
